Pay Duty and Taxes Option Terms and Conditions
You have selected Canada Post’s Pay duty and taxes option for the Package you are tracking. These Terms and Conditions govern your use of the Pay duty and taxes option with respect to that Package. Please read them carefully.
- The Pay duty and taxes option facilitates advance payment of duty and taxes (and corresponding Canada Post handling fees) owing on select Packages. The Pay duty and taxes option is available only for Packages that are trackable using Canada Post’s tracking tool. Other eligibility restrictions may apply.
- You must make payment through a major credit card accepted by Canada Post.
- If you wish to request an adjustment for the amount of duty and taxes owing, you must contact the Canada Border Services Agency directly. You may find more details in sections 45 to 47 of Memorandum D5-1-1 on the CBSA website. Note that Canada Post cannot deliver your Package until you pay the amounts owing, whether or not an adjustment is pending.
- You will be eligible for a refund of duty and taxes (and any corresponding Canada Post handling fee) paid by you using the Pay duty and taxes option, and received by us, if:
- We determine that your Package has been lost in the course of post, in which case a “Refund” option will appear when you enter the applicable Tracking Number for your Package using Canada Post’s tracking tool; or
- Notwithstanding that you have already paid the amounts owing, the Delivery Agent also collects those amounts upon delivery of your Package, because of a delay in transmitting payment confirmation to the Delivery Agent’s hand-held data terminal. In this case we will process your refund automatically upon confirming your payment through the Pay duty and taxes option.
- We determine that your Package has been lost in the course of post, in which case a “Refund” option will appear when you enter the applicable Tracking Number for your Package using Canada Post’s tracking tool; or
- Without limiting any other limitations of liability that apply to delivery of Package items by Canada Post, Canada Post is providing the Pay duty and taxes option “as is” and makes no representations or warranties whatsoever about its reliability, security or any other aspect of the Pay duty and taxes option or its functionality. Use of the Pay duty and taxes option is solely at your own risk. None of Canada Post, its shareholders, affiliates, or any of the foregoing parties’ respective directors, officers, employees or contractors will have any liability whatsoever for any loss or damages arising in connection with your use or attempted use of the Pay duty and taxes option.
This limitation of liability applies (a) no matter what kind of loss or damage you experience, including, without limitation, lost business profits, property damage, personal injury or any other loss or damage; (b) whether the action is in contract, tort or otherwise; (c) even if Canada Post is expressly advised of the possibility of loss or damage; and (d) not matter what caused the loss or damages, including without limitation Canada Post’s negligence or gross negligence.
- You will indemnify Canada Post, its shareholders, affiliates, or any of the foregoing parties’ respective directors, officers, employees or contractors against all claims, damages, losses, fines, expenses (including all legal fees and costs) and/or any other type of liability (collectively, “Claims”) that arise from your use of the Pay duty and taxes option.
- Canada Post may at any time in its sole discretion and without notice (a) modify, suspend or cancel the Pay duty and taxes option; and/or (b) amend these Pay duty and taxes option Terms and Conditions.
- These Pay duty and taxes option Terms and Conditions and your use of the Pay duty and taxes option are also subject to the Canada Post website Terms of Use.
